Terms and conditions for the Sale of Goods on this website.

This is a legal agreement between you and SailClever stating the terms that apply to any purchase made on the SailClever website. By purchasing a product on this website you have agreed to these terms and conditions for the sale of goods. 
 

(1) Policy:  

It is the policy of Embark Technologies Ltd. T/A as Sailclever to deal with our customers in the most professional and courteous way possible. In order to comply with the EU Distance Selling Directive we offer Terms and Conditions free of excessive jargon . Your statutory rights are not affected by anything in the following terms and conditions. 

(2) Data & Privacy:  

The information collected from you at the time you place an order (on you or those you gift to) will be stored in our database and is used purely to carry out your instructions and action your payment. There are no circumstances under which, this information might be passed to a third party. Except for entities nominated by us to facilitate your sales transaction with us. 

Your other interactions with this website are governed by our separate privacy policy and website terms of use.

(3) Supply:  

We undertake to supply you with the goods described in these Web Pages or in our brochure in a timely manner. In the case of software sales these will be made available by electronic download over the Internet from our Website. A license code will also be required to make the software functional this will be supplied by to you  in the member area of the website. 

(4) Technical Steps: 2Checkout.com:

The following steps outline the purchasing process for SailClever software.  2Checkout.com, Inc. (2CO) is the exclusive authorised retailer of goods and services provided by Sailclever.

1. Go to the purchase page on www.sailclever.com
2. Click Buy Online (You will be re-directed to the 2CO website)
3. Buy the product from 2CO.
4. A user account will be created for you with www.sailclever.com
5. Download and install the software.
6. Get the product ID from the software licence menu on the PDA.
7. Input this 8 digit number in the licence section of the user account on www.sailclever.com
8. The website will generate the licence key which they then input on the PDA.
9. Ready to go!

(5) Contact:  

We will only contact you in connection with your instructions and keep you well informed should we have any difficulties providing you with the specific goods ordered. We will not email you at all without your permission. 

(6) Guarantee:  

In the light of the forgoing terms you will appreciate we feel confident that we can unequivocally guarantee your total satisfaction with our product and service. 

(7) Refunds policy:  

If there is a problem with our product or if you are unhappy with it, please contact us   by E-mail as soon as possible. If initial payment was by Credit Card, then the refund will be made back to your Credit Card Company.  

(8) Payment:

The current payment methods available are: online checks; credit or charge cards from Visa, MasterCard. Orders are processed only after a billing address, or other billing information, has been verified. 

(9) VAT:  

VAT (Value Added Tax) is payable on software sold from the Republic of Ireland through 2Checkout.com . Software is subject to VAT at 21% and is included in the price you pay for the product. 

(10) Complaints:

If you are unhappy with the software or hardware solutions supplied by us then please let us know by e-mail and we will deal with all reasonable complaints as best we can. If you are having a technical problem please consult our website and member area. There are numerous FAQs (Frequently Asked Questions) and downloadable manuals to help you. You should find the majority of solutions in these sources. If you have a problem that is not addressed by these sources then contact us. 

(11) Law and Jurisdiction:

Any contract you enter with us for purchase of goods and services from us is governed by and has to be interpreted under the Law the Republic of Ireland and you agree that such contract will be subject to the non-exclusive jurisdiction of the Irish courts.  

(12) Variation 

We may revise these terms and conditions from time-to-time. Please check this page regularly to ensure you are familiar with the current version. 

(13) Sales to end users only. 

We only sell to end users, We do not authorise you to resell the product you purchased from us. We only sell to private individuals.  

(14) Software Licence agreement. 

Your attention is drawn to the software licence agreement which has to be read before using this program. You must read the user manual and associated documentation before using this product.
